This is an appeal against the judgment of the High Court (Fast Track Division), Accra, dated 3rd June, 2010.

The facts giving rise to this action are very simple. The plaintiff sued the 1st defendant as chairman of Greater Accra Car Dealers Association for himself and on behalf of the estate of his two brothers as joint owners of the land in dispute. The facts about the land in dispute are as follows: It is located at Airport area along the Spintex Road. The subject property has been described in a schedule contained in the plaintiff/respondent’s statement of claim.

According to the plaintiff, the disputed land originally belonged to the people of Teshie until 1st September, 1944 when the Colonial Government acquired the said land through the Public Lands Ordinance, Cap 134 (1951 Rev.) under a Certificate of Title for extension of the Accra International Airport.
