The plaintiff claims his land from a sublease from La Hillsview Development Ltd  dated 4th October 2013. The said La Hillsview Development Ltd also got its land from  the Trustees, East Dadekotopon Development Trust (the Trust). The defendants claim  their land from the Ataa Tawiah Tsinaiatse family (represented by Edward Mensah  Tawiah) and Nuumo Ofoli-Kwashie family (represented by Ewormenyo Ofoli  Kwashie) all of La. The defendants have brought this application seeking to dismiss  the suit on the ground that it is an abuse of process and also per the decision of the  High Court presided over by Ofori-Atta J. in Edward Mensah Tawiah and another  v. The Acting Chief Registrar of Lands and another, Suit No. BL431/2006, the  plaintiff as a privy of the Trust is estopped from re-litigating the issues.
