OGUNTADE, J.C.A. (Delivering the Leading Judgment): The issues for discussion in this appeal arose out of the execution processes in connection with the judgment given by the lower court in suit No. ID/2742/92. In that suit the present appellant was the plaintiff and the respondent the defendant. The lower court (Coram Longe J) on 28th May, 1993 gave judgment in favour of the plaintiff in these words:
"(1) Judgment for the plaintiff in the sum of N5.694.864.87 with 40% interest rate per annum from 12/3/90 till 28/5/93 and 6% from 29/5/93 until the amount is fully liquidated.
(2) ?466.000.00 in favour of the plaintiff against the defendant with 40%, per annum interest rate with effect from 12/3/90 till 26/5/93 and 6% interest from 19/3/93 until the amount is liquidated. This amount could be paid in the Naira equivalent at the rate of N37.06 to ?1 which was the rate at the time the suit was filed.
Judgment is there given accordingly.
