This is an appeal against the decision of the High Court Kumasi dated 3rd November 2008 in respect of a piece or parcel of land at Brofoyedru on Kumasi Akwamu Stool land. The Plaintiff, head of the family at Atwima Brofoyedru on behalf of himself and the said family issued the instant writ against the Defendants jointly and severally for:

1. A declaration of title to all that piece or parcel of land situate, being and lying at a place commonly known and called “Nkatieso” at Brofoyedru on Kumasi Akwamu Stool land bounded by the properties of Kokoben Stool, Adumasa Stool and Akwamu Baamu Stool.

2. Perpetual injunction to restrain the Defendants, their agents, servants and workmen from interfering in anyway with the possession and ownership of the land in dispute.”

The Defendants filed a statement of defence and sought by their counter claim for;
