BELLO, C.J.N. (Delivering The Leading Judgment).: In this suit, 14 States of the Federation as the plaintiffs claim against the Federal Military Government and the remaining 16 States of the Federation as follows:
"(1) A declaration that the legislative and executive powers exercisable by the Federal Military Government during the period referred to as 'the transition period' in the Constitution of the Federal Republic of Nigeria (Promulgation) Decree, Cap. 63 Laws of the Federal Republic of Nigeria, 1990 are not capable of over-riding or superceding the express provisions of Section 1 of the aforesaid Decree or Sections 129(b) and 130 of the Schedule thereto.
(2) A declaration that the repeal of the Transition to Civil Rule (Political Programme) (Amendment) (No.3) Decree NO.52 of 1992 and the Presidential Election (Basic Constitutional and Transitional Provisions) Decree No.13 of 1993 is null and void and of no legal consequence whatsoever.
