ABDUL-AZEEZ WAZIRI, J.C.A. (Delivering the Leading Judgment): This appeal probes the judgment of the High Court of Ogun State, sitting in Ota Judicial Division (hereinafter called the lower Court) Coram Judice N. I. Agbelu (J) in Suit No: HCT/248/06, delivered on 30th May, 2014 before the lower Court the Appellants and the Respondent were the respective Plaintiffs and Defendant.

The facts of the case which germinated into the appeal are simple and clear. The Appellants are laying claim to the disputed land which is part of a large tract of land to which the Respondent also lay claim the Appellants beseeched the lower Court and tabled the following reliefs as per their amended statement of claim thus: -

1. A DECLARATION that the Claimants are the owners of a large tract of land lying, situate and being at Iju-Aga in Ifo Local Government Area, Ogun State which land is more particularly delineated in Survey Plan No. SOSA/OG/307/92 and are entitled to the Right of Occupancy.
