JUDGEMENT OF ANNAN J.A.
The appellant sued for "an amount of £G500 being money had and received from the plaintiff as security, plus ten per cent interest as from 1 November 1957 when the security was liberated."
According to the statement of claim the appellant is an illiterate carpenter who was induced to guarantee the employment of one Leon Dequenon with the respondents with the security of £G500 which he paid to them. The respondents took the £G500 from the appellant on a pretence that he was guaranteeing the employment of the said Dequenon when the respondents well knew that the money was not had for any such purpose and that there was no guarantee agreement known to the law. Further, in 1957 when the respondents terminated the employment of the said Dequenon the appellant again wrote to the respondents to demand the return of his £G500 but they denied receiving £G500 from the appellant.
