ADAMU JAURO, JSC (DELIVERING THE LEADING JUDGMENT): The appeal herein is against the judgment of the Court of Appeal, Akure Judicial Division which dismissed the Appellants' appeal and affirmed the judgment of the Federal High Court, Akure Division which had earlier dismissed the Appellants' suit for want of jurisdiction as well as lack of merit.

The 1st Appellant was the person nominated by the Peoples Democratic Party (PDP), the 2nd Appellant herein as its candidate for the Ondo State governorship election. The 2nd Respondent emerged as the candidate of the All Progressives Congress (APC), the 3rd Respondent herein and upon his emergence, he nominated the 1st Respondent as his running mate, that is the 3rd Respondent's deputy governorship candidate.
