JAMES GAMBO ABUNDAGA, JCA (DELIVERING THE LEADING JUDGEMENT): This is an appeal against the judgment of the Federal High Court sitting at Asaba delivered by Hon. Justice I. N. Buba on 29th June, 2012 in Suit No. FHC.ASB/CS/39/2010. This appeal represents the expression of the defendant/Appellant’s dissatisfaction with the judgment being entered in favour of the plaintiff/Respondent.  The Appellant filed its notice of appeal on 8th August, 2012. The notice of appeal which contains four grounds of appeal is on pages 181 -184 of record of appeal while the judgment is on pages 155 – 180 of the record of appeal.

The record of appeal was compiled and transmitted on 18/2/16 but deemed properly compiled and transmitted on 8/2/21.
