OPENE, JCA (Delivering the Lead Judgment): This appeal emanated from the judgment of the High Court of Cross River State holden at Obudu whereby the respondent as plaintiff took out a writ of summons against the appellant as defendant, claiming as follows:- “The plaintiff claims from the defendant the sum of N50,000.00 being general and special damages for trespass to the plaintiff’s family land and destruction of plaintiff’s family economic trees thereon, a declaration that the plaintiff’s A family is and has been the holder of a deemed customary right of occupancy of the said land, a declaration that the purported sales agreement dated the 6th day of January, 1980 is void, and an order of injunction restraining the defendant, his servants, agents and privies from further trespassing into the said plaintiff’s family land situate at Indi Abeb, Atiekpe, Obudu within the jurisdiction of this Honourable Court.
