J U D G M E N T 

The issues and analysis for the judgment in the instant suit are virtually the  same as the issues and analysis for the judgment in Suit 2, Suit No. FAL/62/10  as a result of the consolidation. However, my introduction, findings and  conclusion for both suits are different. 

Plaintiff herein (referred to as Plaintiff in suit 1) initially issued a Writ of  summons against 1st and 2nd Defendants on the 26th February 2010 but Co Defendant was joined to the suit. Plaintiff’s claim per its amended Writ of  Summons and Statement of Claim are for the following reliefs:

1. Declaration of title to all that piece or parcel of land situate at Avenor,  Accra bounded on the North West by the Lessor’s land measuring 350  feet more or less on South East by lessor’s land measuring 350 feet more  or less on the north East by the Odaw river and measuring 200 feet more  or less and on the South West by the lessor’s land measuring 200 feet  more or less and covering an approximate area of…
