TIJJANI ABUBAKAR, J.S.C. (Delivering the Leading Judgment): This is an appeal against the judgment of the Court of Appeal, Yola Division in appeal No. CA/YL/106C/2016 delivered on the 13th day of July 2017 wherein the lower Court dismissed the Appellant’s appeal and affirmed the decision of the trial Court, the Gombe State High Court in charge No. GM/10C/2010. In the said judgment, Appellant was tried, convicted, and sentenced to death. Being severely miffed by the judgment of the trial Court, the Appellant appealed to the lower Court, the Court of Appeal Yola Division. Appellant’s appeal was unsuccessful at the lower Court; he further appealed to this Court via Notice of Appeal filed on the 9th day of August, 2017, premised on nine grounds of appeal. This is therefore the Appellant’s appeal.
