UCHECHUKWU ONYEMENAM, JCA (Delivering the Leading Judgment): Giving rise to this appeal is the dissatisfaction of the Appellant against the Ruling of the High Court of Bauchi State, sitting in Bauchi delivered on 24th February, 2010 in suit No. BA/97/2009; wherein Hon. Justice R. Mustapha struck out the Appellant's case for want of jurisdiction.

By a writ of Summons filed on 14th April, 2009, the Appellant as Plaintiff in his statement of claim seeks the following reliefs against the Respondents jointly and severally, thus:

1. AN ORDER OF DECLARATION that the Plaintiff is the bonafide owner of the land in dispute having purchased the land and remained in effective possession since 1975.

2. AN ORDER confirming the title to the land in dispute on the Plaintiff, same having documented the purchase and Certificate of Occupancy No. BA/8060 since 1987.
