MANGAJI, JCA (Delivering the Lead Judgment): This is an appeal against the judgment of the High Court, Borno State coramA. G. Mshelia J. in suit No. M/72/93 dated 2nd June, 1997 wherein the court entered for the plaintiffs now respondents judgment against the appellant as defendant. In the court below the plaintiffs in the further amended statement of claim as follows:-
“A declaration that the plaintiffs are the lawful title holders of the farmland in dispute. A declaration that Borno State Certificate of Occupancy No. BO/460 was unlawfully issued and that same is null and void and of no effect whatsoever and that same be revoked unconditionally. A A declaration that the purported sales transaction between Bulama Abba and the defendant is null and void and of no effect whatsoever.
An order for perpetual injunction restraining the defendant either by himself or through his servants, agents and purported assigns from further trespassing and/or tampering with the said farm land. N50,000.…
