MUHAMMED LAWAL SHUAIBU, J.C.A.(Delivering the Leading Judgment): This appeal is against the judgment of the Kebbi State High Court in Charge No. KB/HC/22C/2014: THE STATE v. ZAINAB UMARU AIDA. The charge read thus:
That you Zainab Umaru Aida F on or about the 19th day of June, 2014 at about 2:00hrs at Aida in Maiyama Local Government Area within the jurisdiction of Kebbi State High Court of Justice Committed the offence of Culpable Homicide punishable with death in that you caused the death of one Rashida Umaru F by giving her gamalin, an insecticide poison which resulted to her death on the spot with knowledge that death would be the probable and not only a likely consequence of your act and thereby committed an offence punishable under Section 221 (b) of the Penal Code.
