JOHN INYANG OKORO, JSC (Delivering the Leading Judgement): This is an appeal against the judgment of the Court of Appeal Yola Division sitting in Abuja delivered on 18th December, 2023 in the appellants' appeal against the judgment of the Governorship Election Petition Tribunal holden at Yola, Adamawa State delivered on 28th October, 2023. The lower court in its judgment dismissed the appeal of the Appellants. Dissatisfied with the judgment of the Court of Appeal, the appellants have further appealed to this court.

A brief facts of the case giving birth to this appeal are that the 1st Respondent conducted election for the office of Governor of Adamawa State on 18th March, 2023 and for some inexplicable reasons, there was a supplementary election held on 16th April, 2023. While waiting for the result of the supplementary election, the Resident Electoral Commissioner for Adamawa State announced the 1st Appellant as the winner of the said election.
