OMAGE JCA (Delivering the Lead Judgment): This is an appeal against the decision of the Ogun State High Court sitting at Ilaro on 14-10- 94 per O. A. Ajibola J. The appeal was filed on 19-10-94 and amended by order of court on 4th July, 2001 by which further additional grounds of appeal were added to the original grounds of appeal. From the grounds, the appellant formulated in his further amended grounds of appeal eight issues for determination of the appeal. There are two sets of appellants. There are 2nd and 3rd appellants who filed their briefs as one and the 1st appellant whose issues are eight as recorded below, which I will record beneath but I wish first to state the facts of the case which commenced in the High Court, Ilaro.
