OGEBE, J.C.A. (Delivering the Leading Judgment): The respondents by their writ of summons filed on the 4th of June 1993 before Ilorin High Court claimed as follows from the appellants:-
1."A declaration that the plaintiffs are the owners of the church built in Jebba.
2.A declaration that the defendants and their followers are trespassers in the church.
3.Perpetual injunction restraining the defendants from further trespass.
4.Damages for unlawful trespass."
The parties exchanged pleadings which they subsequently amended several times. The respondents ended their pleadings with a further amended statement of claim which was filed with the leave of the court on the 19th December 1994. The 1st and 2nd appellants filed a joint statement of defence while the 3rd appellant
filed his own statement of defence.
The 2nd and 3rd respondents gave evidence on their own behalf and the 1st respondent which is a registered church called one witness PW3 Alhaji Mustaphar Ishola. All the parties originally bel…
