MARY U. PETER-ODILI, J.C.A. (Delivering the Leading Judgment): This is an appeal against the Ruling of the Federal High Court Abuja delivered by Honourable Justice B.F.M. Nyako on 19th May 2005, whereby the court declined jurisdiction to entertain the Appellant's suit.

The Appellant was the Applicant in the court below while the Respondent herein was also the Respondent therein.

FACTS:-

By a Motion Exparte dated 22nd June 2004, the Appellant sought and was granted leave by the lower court to apply for judicial review of the Respondents decision pertaining to him.

Pursuant to that leave the Appellant filed a Motion on Notice dated 7th day of July 2004 seeking the following orders:-
