TABAI, JCA (Delivering the Lead Judgment): This appeal is against the decision of K. A. Jimoh, J. on the 12th day of October, 1995 at the Ogbomoso Judicial Division of the High Court of Justice, Oyo State, in a motion ex-parte filed on the previous day, the 11th of October, 1995. For a proper understanding of the issues involved in this appeal, I state hereunder some facts about other applications which had previously been filed. On the 1st of August, 1995, the plaintiff/appellant/applicant filed a motion on notice for an order of interlocutory injunction -
