BIOBELE ABRAHAM GEORGEWILL, JCA (DELIVERING THE LEADING JUDGMENT): This is an appeal against the ruling of the High Court of Ogun State, Ota Division, Coram: Catherine Ogunsanya J, in Suit No. HCT/26/2009: Mr Olatunji Akeredolu & Ors V. Mr Adeagbo Theo Akinbinu & Ors delivered on 5/5/2015, in which the Appellants, as Defendants/Applicants, were ordered to deposit the sum of ₦100,000.00 as cost for security for the diligent prosecution of their Defense.
The Appellants were peeved with the said ruling and had appealed against it vide their Notice of Appeal filed on 19/5/2015 on one Ground of Appeal. See pp 13 - 14 of the Record of Appeal. The Record of Appeal was compiled and transmitted to this Court on 31/12/2015. The parties filed and exchanged their briefs, namely: The Appellants’ brief and the Respondents’ brief. The Respondents filed a Notice of Preliminary Objection on 17/2/2025. However, the Appellants did not file a reply brief.
