NONYEREM OKORONKWO, J.C.A. (Delivering the Leading Judgment): On 7th July, 2006, a Legal Practitioner L. K. O, Alabi describing himself as Attorney instituted this suit in the name of Miss Bernice Durojaiye Akinduro against the respondents in the High Court of Ogun State.
It was a fully fledged land suit by which L. K. O. Alabi Esquire of counsel as attorney claimed for:
"An order of perpetual injunction restraining the defendant, their privies agents or assigns from committing further acts of trespass on the plaintiff's piece or parcel of land lying situate and being at No. 5 Popoola Street, Jegede-Enilolobo village, near Oke-Aro in Ifo Local Government Area, Ogun State.
In the accompanying statement of claim, Mr. Alabi of counsel described the land in dispute as lying at No. 5 Popoola Street in Ifo Local Government Area, Ogun State and being about 9 acres and bounded by "Iju Stream and a ditch.
