TABAI, J.C.A. (Delivering the Leading Judgment): The life of this case started at the Ibadan Judicial Division of the High Court of Justice, Oyo State on the 20th Octoher, 1986 when the writ of Summons was issued. Pleadings were filed and exchanged. In paragraph 55 of the Amended Statement of Claim, filed on the 24th January, 1990 the plaintiff/appellant claimed as follows:
"(a) Declaration that Logunleko family is entitled to the Statutory Right of Occupancy to the piece of land on the site of the Mosque facing Ode-Aje Road part of which are situated two shops;
(b) Perpetual injunction restraining the Defendants, their servants, agents or any person claiming through them from re-writing Mosalasi Ile-Balogun on the walls of the mosque situate lying and being at Logunleko's land at Ode-Aje Ololu Ibadan.
And in paragraph 54(c), the plaintiff averred and claimed in the following terms:
