STEPHEN JONAH ADAH, J.C.A. (Delivering the Leading Judgment): At the High Court of Akwa Ibom State, the Respondents in this appeal took out as Plaintiffs a writ of summons on the 2nd day of December, 1998 against the 1st, 2nd and 3rd Defendants claiming four reliefs. The reliefs claimed are worded as follows:
1. An order of Court for the Defendants to surrender the document of title to the Plaintiffs in respect of property known and called and described as No. 10 Urua Street, Ewet Offot, Uyo Local Government Area sold by the Defendants to the Plaintiffs in a public auction.
2. A declaration that the Plaintiffs are the sole owners of the property described as No. 10 Urua Street, Ewet Offot, Uyo having purchased same by a Public Auction on 17th April 1998 as the highest bidder after the fall of the hammer.
3. A declaration that the 1st Defendant letter Ref. No. FMFL/UYB/AD/402 dated 11th August, 1998 with the Caption "CANCELLATION OF AUCTION SALE PROPERTY OF MR. A. I, AKPAN ACCOUNT NUMBER …
