ALOMA MARIAM MUKHTAR, J.C.A. (Delivering the Leading Judgment): The following is the content of a writ of summons taken by the plaintiffs in the lower court who are respondents in this court against the defendants who are now the appellants:-

(1) Declaration that the defendants are up till the 25th day of March, 1991, the plaintiffs' Customary Tenants on the plaintiffs' farmland situate being and lying at Ibapon village in Ogbomoso District in Oyo State of Nigeria which parcel of farmland shall be more clearly shown, described and demarcated in a survey plan to be filed later in this suit.

(2) Declaration that by the judgment of the Oshun North West Grade 'B' Customary Court, Ogbomoso delivered in suit No. C.41/70: Salami Akanni (For himself and members of Garuba Ajao Family v. Aborode Alade and Family delivered on or about the 25th March, 1971 the defendants' said customary tenancy on the said parcel of farmland had been forfeited.
