NZEAKO, J.C.A. (Delivering the Leading Judgment): The appellant in this appeal was the petitioner in the election petition which he filed at the Benue State Local Government Council Election Tribunal sitting in Makurdi.
The appellant and the 1st respondent were the candidates at the election for the position of Chairman of Makurdi Local Government Council, Benue State.
The appellant was a candidate of All People's Party (APP) while the 1st respondent was a candidate of the People's Democratic Party (PDP) at the election.
At the conclusion thereof, the 1st respondent was declared winner by the Independent National Electoral Commission (INEC), the 5th respondent.
The 2nd respondent was the returning officer Makurdi Local Government Council, the 2nd respondent, the returning officer of Fiidi Ward and the 4th respondent the Electoral Commissioner, INEC, Makurdi.
