JUDGMENT: 

This is a consolidated suit. Suit numbered IRL 293/09 will be referred to  as Suit A and FAL 157/11 as Suit B. By the plaintiff’s writ of summons in  Suit A filed on 5th May 2009 which was amended on 22nd December  2011, he claims against Simavi Company Limited the following reliefs: 

1. Declaration of title to all that piece or parcel of land situate lying at  Martey Tsuru, Accra containing an approximate area of 1.365  acres or 0.553 hectares more or less bounded on the North West  by proposed road measuring 126 feet and 143 feet more or less  on the North East by a proposed road measuring 202 feet more or  less on the South East by proposed road measuring 237 feet more  or less and on the South West by lessors land measuring 251 feet  more or less.

2. An order for cancellation of Land Certificate No. GA26740 standing  in the name of defendant as having been procured by mistake as  being without the consent of the true owners, the plaintiff’s  grantors.
