UGOCHUKWU ANTHONY OGAKWU, JCA (Delivering the Leading Judgement): The Appellant was arraigned before the High Court of Borno Sate on a one count Charge of criminal breach of trust in CHARGE NO. BOHC/MG/CR/116/2020: FEDERAL REPUBLIC OF NIGERIA v. ALHAJI BUNU SHERIFF. The Appellant pleaded not guilty to the Charge and at the end of the trial, the lower court held that the offence charged had been proved beyond reasonable doubt. It consequently convicted the Appellant and imposed sentence in the following terms:
“I have considered the plea of the counsel for the convict and the submissions of the prosecution counsel. I have taken into consideration the provisions of section 312 of the Penal Code Law Cap. 102 Laws of Borno State of Nigeria 1994. Consequently, the court order as follows:
