JAMILU YAMMAMA TUKUR, J.S.C. (Delivering the Leading Judgment): The appeal is against the decision of the lower court delivered on 7th December 2018 wherein judgment was entered in favor of the respondents.
The material facts have been eloquently set out in the 1st respondent's consequential amended brief of argument filed on 16/4/2024 and deemed properly filed and served on 3/5/2024, and for ease of reference, they are set out hereunder;
The 1st respondent, together with the other respondents herein, instituted this suit against the appellant at the trial court in suit no. USC/JG/CV/48/2016, wherein they claimed that the disputed farmland belonged to their late Alhaji Haruna III, Sarkin Kabi Jega, who died in the year 2006, and which farmland has been in the possession of the appellant. The respondents prayed for the court to share the said farmland among the heirs as part of the estate of the late Alhaji Haruna in Sarkin Kabi, Jega.
