ADEBUKUNOLA ADEOTI BANJOKO, JCA (DELIVERING THE LEADING JUDGEMENT): The Appeal is against the Judgment delivered by Honourabie Justice K. N. OGBONNAYA of the High Court of ihe Federal Capita! Territory on the 11th day of March, 2022 in Suit No:FCT/HC/CV/893/2020 as seen at Pages 47 to 53 of the Record of Appeal and at Pages 54 to 60 of the Supplementary Record of Appeal.
The Respondents, as Claimants had approached the Trial Court, vide a Writ of Summons brought pursuant to Order 35 of the Federal Capital Territory High Court (Civil Procedure) Rules, 2018 under the Undefended Cause List Procedure. The Writ was filed on the 23rd day of January, 2020 and had claimed for the foiiowing:
