OGEBE, J.C.A. (Delivering the Leading Judgment): The appellant was plaintiff in the lower court and he sued the respondents who were the defendants in the lower court claiming in his writ of summon the following reliefs: -

"1. A declaration that the plaintiff is the family head of late Aligwo's family who died intestate on the 23rd of January, 1970 in accordance with the Ibo tradition and custom.

2.A declaration that the plaintiff is the trustee and in possession of the property situated and lying at GG 5 Warri Street, Kaduna and covered by Kaduna Local Government certificate of occupancy No. 002075 issued to the plaintiffs late father.

3.A declaration that the plaintiff has not sold the property to the defendants or any other person whatsoever and whomsoever.

4.A declaration that the purported sale of the said property to the defendants by some members of the plaintiff's family is illegal, null and void and of no effect whatsoever as necessary consents werenot sought and obtained before …
