OMAGE, J.C.A. (Delivering the Leading Judgment): For a fuller appreciation of the issues in this appeal, it is relevant first to state the facts. The facts are as follows. Twenty four people who are all members of the workers union and members of the staff of Ahmadu Bello University Teaching Hospital went to Samaru, as a result of a common agreement. According to the statement of DW2 after a meeting at the Endoscopy department office at 8.30 an agreement was made on 26/10/95. The DW2, said the object of the meeting was to "abduct Prof. Bandipo on Monday 30/10/95, at about 7.30 hours and bring him down to ABUTH mortuary Zaria and hold him there until he pays us."
Following the agreement the other members of the workers Union were directed according to DW 1, Danjuma Aliyu, to meet Prof. A.B. Bandipo.
