DANLAMI ZAMA SENCHI, JCA (Delivering the Leading Judgment): The Appellant in this matter is one of the registered political parties in Nigeria. The Appellant is sponsoring a candidate for the Presidential Election fixed by the 1st Respondent herein to take place on 25th February 2023. In the same way, the 2nd Respondent is sponsoring the 3rd Respondent herein as its candidate for the said Presidential Election. The Appellant, contending that the 3rd Respondent is not qualified and/or is disqualified from contesting the said Presidential election, on account of the manner in which he emerged as the candidate of the 2nd Respondent, instituted proceedings by Originating Summons before the Federal High Court, Abuja Division in SUIT NO. FHC/ABJ/CS/1743/2022: ALLIED PEOPLES MOVEMENT v. INDEPENDENT NATIONAL ELECTORAL COMMISSION (INEC) and ORS.
