JOSEPH OLUBUNMI KAYODE OYEWOLE, J.C.A.(Delivering the Leading Judgment): This is an appeal against the judgment of the High Court of Akwa Ibom State sitting in Uyo delivered on the 3rd March, 2016 by Joy I. UNWANA J.
The Appellant as Plaintiff had pursuant to a dispute with the Respondent as Defendant over a parcel of land known as Ekpene Obo, lying and situate at Ibiaku Issiet, Uruan Local Government Area of Akwa Ibom State approached the trial Court via a writ of summons dated 27th October, 2014 seeking the following reliefs:
1. Special and general damages to the tune of N20,000,000.00 (Twenty Million Naira) against the Defendant for trespass to the property known as Ekpene Obo, lying and situate at Ibioku Issiet, Uruan Local Government Area of Akwa Ibom State.
