R. D. MUHAMMAD, J.C.A. (Read the Leading Ruling): The appellant/respondent herein, Rt. Hon. Rotimi Chubuike Amaechi, is a member of the Peoples Democratic Party (hereinafter referred to as "PDP") the third respondent herein. The appellant/respondent was screened and cleared to contest the primaries of the PDP for the Governorship election for Rivers State. At the primaries election conducted by the PDP, the appellant/respondent emerged the winner. His name was then forwarded to INEC, the 1st respondent, as the Governorship candidate of the PDP for Rivers State. That was on 14th December, 2006. However, on 2nd February, 2007, PDP wrote to INEC intimating INEC that the name of the appellant/respondent was forwarded to them in error and as such they were substituting the appellant/respondent with the 2nd respondent herein, i.e. Celestine Omehia.

The appellant/respondent was aggrieved by the turn of events.
