YARGATA BYENCHIT NIMPAR, J.C.A. (Delivering the Leading Judgment): This appeal is against the ruling of the Lagos State High Court delivered on the 22nd October, 2014 wherein the Court below dismissed a preliminary objection brought by the Appellant challenging the jurisdiction of the Court and held that it has jurisdiction to hear the main claim. Dissatisfied with the decision, the Appellant filed an amended Notice of Appeal dated 4th day of February, 2016 and filed on the same day setting out 3 grounds of appeal.

The Respondent took out a writ of summons against the Appellant and one other claiming declaratory orders and the sum of N19,650,000.00 (Nineteen million six hundred and fifty thousand Naira) only being special damages for loss of outstanding legal fees for services rendered to a client and for which the defendants by their base action and improper conduct caused loss to the claimant.
