JAMILU YAMMAMA TUKUR, J.C.A. (Delivering the Lead Ruling): This is a Motion on Notice filed on 9th May, 2017 by the 1st Respondent/Applicant pursuant to the Provisions of Order 6 Rule 9, Order 9 Rules 2 and 3 of the Court of Appeal Rules 2016 and under the inherent jurisdiction of this Court. The 1st Respondent/Applicant seeks the following reliefs:-
1. An Order for Extension of Time within which the 1st Respondent may give and serve Respondents Notice to contend that the decision of the High Court of Lagos State per Hon. Justice E.O. Adebayo delivered on 27/10/2009 in Suit No: BD/36/2009 between Prince Amos and 5 Ors v. Mr. Okoya and 6 Ors should be affirmed on grounds other than those relied upon by the Court below.
