THOMAS, J.C.A.(Delivering the Leading Ruling): In suit No. 0/669/2001 at Onitsha High Court, the present respondent, but plaintiff at the lower court claimed damages for defamation of his name against the defendant but presently the appellant/applicant. The plaintiff/applicant did not enter appearance, nor did he file a statement of defence when the matter was first heard before Obdigwe (J), who later, transferred the suit to Umeadi (J). Again the suit was further transferred to Nwadi (J). It is not in dispute that in all the transfers of the suit from one judge to other judges, all were on the belief of defendant/applicant that, the four judges were biased against his interest. These believes are from the applicant’s affidavit, further affidavit, and further further affidavits, all in support of his two motions. The respondent’s counter and further counter affidavits in opposition to the applicant’s two motions are much clear to the applicants perceived or imaginary accusations again…
