ONNOGHEN, JCA (Delivering the Lead Judgment): This is an appeal against the judgment of the Kwara State High Court presided over by Hon. Justice J. A. IBIWOYE, in suit No. KWS/32/92, delivered on 30th July, 1993, dismissing the appellant’s claim against the respondents.

By a writ of summons filed on 12/2/92 to be found at pages 5 and 6 of the record, the appellant claimed against the respondents as follows:-

“The plaintiff’s claim against the defendants jointly and severally is for:-

The sum of seventy thousand Naira (70,000.00) only being general damages for libel maliciously published of and concerning the plaintiff in the news daily, DAILY SKETCH edition of January 6, 1992 ; An order that the defendants retract the aforesaid libellous publication and tender a clearly worded apology to the plaintiff on the back page of an issue of the DAILY SKETCH.” The words complained of as constituting the alleged libel are pleaded in paragraph 5 of the statement of claim to be found at pages 6 to…
