JUDGMENT
1.0 INTRODUCTION
1.1. On 11th March 2019, the plaintiff instituted action against the defendant claiming certain reliefs I will set out in a moment. The defendant personally entered conditional appearance to the writ of summons on 25/3/19 and subsequently engaged a lawyer who filed his appointment of solicitor on 2/4/2019 and also filed motion on notice for the suit to be dismissed or the writ set aside.
1.2. On 7th May 2019 the court differently constituted dismissed the motion and subsequently, the defendant filed statement of defence and a counterclaim on 14/5/19. After close of pleadings, the court set down the issues and additional issues for trial. The parties were ordered to file their witness statements.
1.3. On 09/10/2020, the court granted leave to the defendant to amend his defence and counterclaim and the amended statement of defence with the counterclaim was filed on 12/10/2020.
