GALADIMA JCA (Delivering the Lead Judgment): The plaintiffs’ claim as amended in their further amended writ of summons dated 29/6/ 2001 are as follows: “1. A declaration that the title of “Olu Epe of Epe” is a chieftaincy title of a chief and is not that of an Oba (King).
A declaration that the 1st, 2nd and 3rd defendants have no powers to make a declaration and/or proclamation and/or install any holder of the title of Olu Epe of Epe as an Oba and/or upgrade the title of Olu Epe to that of an Oba without following or complying with the laid down procedure thereof under the Obas and Chiefs Law No. 6 of 1981, Laws of Lagos State of Nigeria (now Cap. 138 Laws of Lagos State, 1994) and any other Law regulating chieftaincies or the upgrading of chieftaincies.
