(Delivering the Leading Judgment): The instant appeal is against the judgment of the Delta State High Court of Justice Kwale Division, in Suit No. HCK/MISC.52/2007 between Mr Eberechukwu Anyaeche and E.C. Eche Investment Co. Nig. Ltd against Okwuchukwu Nduka, delivered on the 19th of February, 2010 by the Hon. Justice G.B. Briki-Okolosi J.
