HARUNA SIMON TSAMMANI, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the Oyo State High Court of Justice sitting in Ibadan, delivered on the 15th day of January, 2013 in Suit No: I/265/2005.

The Claims of the Respondent who was the Plaintiff in the Court below as stated in paragraph 18 of the Statement of Claim are as follows:

(1). A declaration that the Plaintiff is the person who is exclusively entitled to a Customary Right of Occupancy in respect of ALL THAT piece or parcel of land situate, lying and being at Kure Village, Amuloko, Off Akanran Road, Ibadan.

(2). The sum of N5,000.00 as general damages for continuous act of trespass being committed by the Defendants on the Plaintiffs said pieces or parcels of land situate, lying and being at Kure Village, Amuloko, Off Akanran Road, Ibadan.

(3). Perpetual Injunction restraining the Defendants by themselves, their servants, agents and or privies from further acts of trespass on the Plaintiffs piece or…
