OKUNOLA, J.C.A. (Delivering the Leading Judgment): This is an appeal arising from the Local Government Election Tribunal sitting at Abeokuta in Ogun State delivered on 15th of February, 1999. The petitioner (hereinafter referred to as the appellant) being dissatisfied with the decision appealed to this honourable court on 22nd February, 1999 (i.e.) within 7 days of the decision as stipulated by the Decree. Today, the appellant brought an application to file the appellant's brief contrary to the Practice Direction on such appeals issued by the President of this court requiring an appellant to file his brief along with the notice of appeal and serve same on the respondent.

By Decree 36 of 1998 the respondent has seven days to file the respondent's brief after being served the appellant's brief. This appeal expires tomorrow 23rd March, 1999 hence the appeal will be ripe for hearing and conclusion on 23/3/99 - 30 days after the filing of the appeal. On counsel's attention being pointed to …
