RAPHAEL CHIKWE AGBO, J.C.A. (Delivering the Leading Judgment): The parties in this case are the same as in CA/OW/EPT/IM/SN/02/2016 earlier determined this morning. The ruling appealed against are the same and the issues raised in the two appeals are the same.

This appeal therefore abides the judgment in CA/OW/EPT/IM/SN/02/2016 I find it completely unnecessary to reharsh the facts and issues contained therein as the facts and issues are the same. The said issues have been resolved in the said judgment. This appeal is also dismissed with N50,000.00 costs to the 1st Respondent.

AYOBODE OLUJIMI LOKULO-SODIPE, J.C.A.: I agree entirely with the reasoning of my learned brother, AGBO, JCA; in dismissing this appeal in the lead judgment and I have nothing to add thereto.

Accordingly, I too dismiss the appeal as lacking in merit. I also abide by the order in relation to costs made in the lead judgment.
