OLUKAYODE ADEGBOLA ADENIYI, J.C.A. (Delivering the Leading Judgment): This is an appeal against the decision of the High of Niger State, Minna, coram Abdullahi Mikailu, J.
The suit was instituted by the 3rd Respondent, Dr. Ibrahim Abdullahi Aloma, challenging the alleged substitution of his name as the consensus winner of the Local Government Area Chairmanship primaries of Niger State, conducted by the Appellant, with that of the 1st Respondent, who had also participated in the primaries but was not returned as the nominee.
The 3rd Respondent contended that his name was wrongfully replaced in the list of nominated candidates submitted to the 2nd Respondent, the Niger State Independent Electoral Commission (NSIEC).
The 3rd Respondent (as Plaintiff) therefore took out an Originating Summons at the lower Court, whereby he sought the determination of the questions set out as follows:
