OSEJI JCA (Delivering the Lead Judgment): This appeal is against the judgment of the High Court of Lagos State, Ikeja Division, delivered by A. O. Adefope-Okojie J. on 5 April 2006 in suit No. ID/1319/97.

The respondents herein had as plaintiffs in the lower court commenced an action against the defendants (now appellants) and by an amended writ of summons and amended statement of claim dated the 13 June 2000 sought the following reliefs against the appellants:-

1. A declaration that the acts of the defendant, her children and agents in disturbing the plaintiffs quiet enjoyment of the plots known as Nos. 16 and 20, Abe Road, Onipanu, Lagos is illegal, unlawful and an act of trespass to the said lands.

2. An award of N10,000,000.00 (ten million naira) as damages against the defendant for committing the said act of trespass on the said Nos. 16 and 20 Abe Road, Onipanu, Lagos properties of the plaintiffs.
