(Delivering the Lead Judgment): This is an appeal against the judgment of the Court of Appeal, Yola division in Appeal No. CA/YL/80/2019 coram James Shehu Abiriyi, Chidi Nwaoma Uwa and Abdullahi Mahmud Bayero, JJCA delivered on the 6th day of November, 2019 wherein the Court below set aside the judgment of the trial Federal High Court, Taraba Division in Suit No. FHC/JAL/CS/11/16.
The Appellant who was the Applicant before the trial Court, filed an originating motion under the Fundamental Rights (Enforcement Procedure) Rules, 2009, seeking for the following orders:
