STEPHEN JONAH ADAH, J.C.A. (Delivering the Leading Judgment): This is an Appeal against the decision of the Akwa-Ibom State High Court sitting at Itu in Suit No. HIT/FHR.23/2014 delivered on the 6th day of October, 2015.
The Respondent in this Appeal originated the suit at the trial Court through Fundamental Rights (Enforcement Procedure) Rules, 2009, against the Appellant.
The reliefs claimed from the records are four (4). They were expressed as follows:
1. A declaration that the arrest and detention of the Applicant by the police on the investigation of the 1st 8th Respondents on the facts of this case was unlawful and unconstitutional.
2. A declaration that the Order of Respondents restricting the Applicant and members of his family from associating or relating with other members of the village based on the facts of this case is unlawful and unconstitutional.
