OGEBE, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of Adeniyi J. of the Kwara State High Court sitting at Ilorin delivered on the 22nd day of November, 1994. The appellants as plaintiffs commenced this action by a writ of summons filed at the trial court on the 21st day of October 1981. Pleadings were ordered, filed and exchanged and amended several times by the parties. The pleadings were finally settled at the state of amended statement of claim of 47 paragraphs and a further amended statement of defence of 59 paragraphs. In the amended statement of defence the respondents endorsed a counter-claim. The claims of either side were mainly declaratory and injunctive with regard to Alara of Isare-Opin chieftaincy which was being disputed between the 1st appellant and the 1st respondent.
